Florida Law F.S. 626.015(6) defines “customer representative” as a person appointed by an agent or agency to assist that agent or agency in conducting insurance business from the office of that agent or agency. F.S. 626.7352 further defines “client representative’s office” as a place where the client representative shall be wholly and entirely within the physical boundaries of the office of the agent or agency he or she represents. The Agreement also states that the Customer Representative shall not maintain such office or furniture, books, records, equipment or utensils at any other address or location, nor shall he or she maintain or use any other accommodation, space or address. , for the purpose of conducting such business. No customer representative may be engaged from any location except where an agent licensed to write such lines spends his full time at such location.
Therefore, a representative of 4-40 clients who works remotely is, under the Florida Statute, considered an unlicensed representative and therefore should not have any contact with any clients. Gold Coast Schools reached out to Jean Jeune (Director of Education, Florida Department of Finance, Office of Licensing: Division of Education) and asked if the restrictions on 4-40 customer representatives working remotely would be lifted during the recent Governor. declaration of emergency.
