Courts used to award about one month’s salary per year of service as a reasonable common law split. While that is an old law, it can sometimes be used as a rough estimate. The purpose of the separation in these cases is to determine the period during which the employee will be able to find comparable employment.

Severance pay must be paid within 7 days of termination of employment or whichever day is the employee’s next pay day – whichever is later. Employers also have the option to pay in installments. Installment plans require the written consent of the employee or the approval of the Director of Employment Standards of the Ministry of Labor. The payment plan can be no more than 3 years and if the employer is unable to pay, the division of all employees will be determined immediately.

Determine how to calculate wages: Multiply the employee’s regular weekly wages by the sum of the number of completed years and the number of completed months divided by 12 for incomplete years.

Set only the minimum requirements for severance, called legal rights. The employee’s statutory entitlement is 1 week of allowance per year of employment, up to a maximum of 26 weeks.

Employees may be entitled to compensation under common law. Legal severance is generally more money than the statutory minimum. However, access to these rights generally requires a lawyer to assist in negotiations or litigation for the maximum amount. Employees are not entitled to common law severance if they have an employment contract that stipulates a different calculation of their severance package or limits their rights to their statutory minimum.

Can My Employer Change My Severance Pay?

There are a number of factors involved in the calculation of common law rights including age, length of employment, position, etc. These factors can affect the amount of severance owed to the employee. For example, older employees are generally entitled to greater notice periods and related pay, as are those holding more senior or managerial positions. Although the availability of new jobs, and the possibility of downsizing, are factors that employers must consider.

The bottom line is that determining severance is not as simple as plugging numbers into a calculator. The basic ESA formula for calculating severance can give you a rough estimate of the amount you are entitled to, but you can be entitled to more. Determining the full amount of severance to which you are entitled requires a careful evaluation of your employment, agreement or contract, and consideration of many complex factors. The Court clearly recognized that an employer’s obligation to pay statutory severance pay is based on the size of their total salary. Computation of salary under s. 64 of the ESA [statutory arbitration provision] does not limit Ontario employment; Employment outside Ontario, including employment outside Canada, must be included.
